2. Information we collect
We only collect personal information that is reasonably necessary for our business activities.
Depending on how you interact with us, this may include:
-
your name, email address and telephone number
-
information contained in an enquiry, contact form or message
-
the Bailey Group development, property or home you are interested in
-
information you provide through our website, social media advertising, lead forms, email, telephone or directly to our team

You are generally not required to provide us with personal information. However, if you choose not to provide information required for an enquiry, we may be unable to provide the requested plans, pricing, availability or other assistance.
3. How we collect information
We may collect personal information directly from you when you:
submit an enquiry through our website, complete an advertising or social media lead form, contact us by telephone or email, register your interest in a development, attend a viewing or event, or otherwise communicate with Bailey Group.
We may also receive personal information about you from another organisation, including an appointed real estate or sales agent, an advertising platform, a service provider, or another party involved in responding to your enquiry.
Where we collect personal information indirectly, we will take reasonable steps to ensure you are aware of the collection and how your information will be used where required by the Privacy Act.
4. How we use your information
We may use your personal information to:
respond to your enquiries, send you requested plans, pricing, specifications or availability information, communicate with you about a property or development you have expressed interest in, arrange property viewings or sales discussions, facilitate the sale and purchase process, provide customer service, maintain appropriate business and sales records, improve our services and communications, protect our business and systems, and comply with legal or regulatory requirements.
If you enquire about a particular Bailey Group development, we will generally use your details in connection with that enquiry and that development.
We will not automatically add you to unrelated property marketing or marketing lists unless you have requested or authorised this, or the additional use is otherwise permitted by law.
5. Sharing information with our appointed sales agents
Bailey Group may appoint licensed real estate agencies, sales agents or other sales professionals to assist us with marketing and selling particular developments.
Where you enquire about a development represented by one of our appointed agents, we may provide that agent with relevant personal information, including your name, contact details and enquiry information, so they can:
respond to your enquiry, provide plans, pricing or availability information, contact you regarding the development, arrange viewings, and assist with the property purchase process.
For example, Whitestone Group is an appointed sales agent for Birkdale Cottages, and enquiries relating to Birkdale Cottages may be shared with Whitestone Group for these purposes.
We only share information with an appointed sales agent where that agent has been engaged by us to assist with the relevant development or sales process.
6. Other organisations we may use
We may also provide personal information to trusted organisations that provide services to Bailey Group where reasonably necessary for them to perform those services.
These may include website and hosting providers, email and communications providers, CRM or enquiry-management systems, cloud storage providers, advertising and social media platforms, IT providers, professional advisers and other contractors acting on our behalf.
These providers are expected to handle personal information appropriately and only for the purposes for which they have been engaged.
We may also disclose personal information where required or permitted by law.
We do not sell personal information and we do not provide your information to unrelated third parties for their own marketing purposes.
7. Overseas processing and storage
Some technology or service providers used by Bailey Group may process or store information outside New Zealand.
Where personal information is disclosed outside New Zealand in circumstances covered by the Privacy Act, we will take reasonable steps to ensure appropriate privacy protections are in place.
Where an overseas provider is simply storing or processing information on our behalf, Bailey Group remains responsible for the information in accordance with applicable New Zealand privacy requirements.

These technologies may collect information such as your browser or device type, IP address, website activity and interactions with our advertising.
You can manage or restrict cookies through your browser settings and, where available, through website cookie controls.
9. Security
We take reasonable steps to protect personal information against loss, misuse, unauthorised access, disclosure, alteration or other misuse.
Personal information may be stored electronically or through reputable third-party technology and cloud service providers.
No internet or electronic storage system can be guaranteed to be completely secure, but we use safeguards that we consider reasonable for the nature of the information we hold.
If Bailey Group experiences a privacy breach that has caused, or is likely to cause, serious harm, we will comply with our notification obligations under the Privacy Act.
10. How long we keep information
We will only retain personal information for as long as it is reasonably required for the purposes for which it may lawfully be used.
When personal information is no longer required, we may securely delete, destroy or anonymise it, subject to any legal, accounting, contractual or legitimate business record-keeping requirements.
11. Accuracy of information
We take reasonable steps before using or disclosing personal information to ensure it is accurate, up to date, complete, relevant and not misleading.
If any information we hold about you changes, you are welcome to contact us so that we can update our records.
